Introduction
Welcome to the website of Until There Are Nine® (“UTAN”). These Terms of Use (“Terms”) govern your use of our website, services, and content (collectively, the "Services"). By accessing or using our Services, you agree to comply with these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By using our Services, you agree to these Terms, which constitute the entire agreement between you and UTAN. You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use our Services. If you are using our Services on behalf of an entity, you confirm you have the authority to bind that entity to these Terms. If you do not agree to these Terms, please do not use our services.
2. Modifications to Terms
UTAN reserves the right to modify these Terms at any time without specific notice to you. Any changes will be posted on our website, and your continued use of the Services will signify your acceptance of the updated Terms. We encourage you to review these Terms periodically.
3. Privacy Policy
Our Privacy Policy is incorporated into these Terms by reference. By using the Services, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.
4. Membership Services
Until There Are Nine® is a membership platform designed to help women secure fair compensation and career advancement opportunities through a combination of proprietary resources, coaching, and personalized advice from experienced Advisors. Our services include access to Payscale salary data, 1:1 Advisor sessions, group coaching, and career templates, among others.
When you sign up as a Member, Advisor or for the Newsletter, you agree to receive emails and other communications from Until There Are Nine. You may update your preferences at any time.
5. Use of Services
You are required to register for our Services. You agree to provide accurate and complete information during registration and update it as necessary. You are responsible for all activities conducted under your account and must notify us of any unauthorized use. UTAN reserves the right to suspend or terminate accounts for unauthorized activities.
6. Member’s Role & Responsibilities
- To learn from your Advisor based on their experience and guidance provided in the Playbook. The advice applied is at your sole discretion.
- To understand that the Advisor is not to be “employer facing” during any part of compensation discussions - in person, on calls or in writing (cc’d in emails).
- To expect confidentiality and zero conflicts from your Advisor. Any information shared (i.e. salary) is at your sole discretion.
- To seek advice from an employment lawyer, financial advisor or accountant as guidance provided by Advisor is not meant to serve as a substitute.
- To maintain a professional and respectful demeanor towards the Advisor and expect the same in return.
- To take responsibility of scheduling calls with your Advisor and sending any documents for review at least 24-48 hours prior.
7. Advisors' Role and Limitations
- To respect the confidentiality of your employment circumstances and any confidential information shared (e.g. previous or current salary).
- To be conflict free and not benefit financially, reputationally or otherwise from your career outcome. Any conflicts of interest should be disclosed immediately.
- To give you the time and attention you deserve within reasonable and appropriate timeframes and maintain a professional and respectful demeanor.
Our Advisors provide guidance based on their professional experience. However, they are not acting as legal, financial, or accounting professionals. Any advice given by an Advisor should not be construed as legal, financial, or professional advice. You are solely responsible for how you choose to use any advice provided by an Advisor, and we encourage you to seek professional advice from qualified attorneys, accountants, or financial advisors when needed.
8. No Liability for Advice
By participating in any Advisor sessions or using any of the resources on our platform, you acknowledge and agree that Until There Are Nine® and its Advisors are not responsible for the outcome of any decisions you make based on the advice provided. You agree that you use the advice at your sole discretion and risk. UTAN and its Advisors shall not be liable for any damages, losses, or other consequences resulting from your use of the advice, resources, or information provided.
9. Salary Data
We provide access to salary data from Payscale to assist you in your compensation negotiations. This data is intended for informational purposes only. You are responsible for interpreting and using this data in your career decisions. UTAN does not guarantee the accuracy or applicability of the salary data for your specific situation.
10. Membership and Auto-Renewals
When you subscribe to a membership plan, your membership will automatically renew at the end of each term unless you cancel it. You will be charged the applicable fees for the renewal term unless you cancel prior to the renewal date. You may cancel your membership at any time by contacting us at info@untiltherearenine.com or through your account settings on our website. If you cancel your membership, your access to the Services will continue until the end of your current term, and no refunds will be issued for the remaining period.
11. Feedback
By providing feedback or suggestions to improve our services, you grant UTAN an irrevocable, royalty-free, worldwide license to use, modify, and incorporate such feedback into our services at our discretion. We are under no obligation to implement any feedback provided.
12. Confidentiality
We respect the confidentiality of any information you share with us during Advisor sessions or through our platform. Our Advisors will maintain the confidentiality of your employment circumstances, salary information, and any other private details you disclose unless required by law to disclose such information.
13. Intellectual Property
All content on our Services, including text, graphics, logos, images, and software, is the property of UTAN or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.
14. Third-Party Links and Content
Our Services may contain links to third-party websites or content. We are not responsible for the accuracy or reliability of such content. You use such content at your own risk.
15. Trademarks
All trademarks, logos, and service marks displayed on our Services are our property or that of our licensors. You are not permitted to use these marks without prior written consent.
16. Limited License
We grant you a non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes, subject to these Terms. You agree not to use our Services for any unlawful or prohibited activities.

18. Disclaimer of Warranties
Our services are provided "as is" without any warranties, express or implied. UTAN makes no guarantees regarding the accuracy, reliability, or results of using our services or resources.
19. Limitation of Liability
To the maximum extent permitted by law, UTAN and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. In no event will our total liability exceed $100.
20. Indemnification
You agree to indemnify, defend, and hold harmless UTAN, its Advisors, and employees from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of our services or any breach of these Terms.
21. Termination
We may suspend or terminate your access to our Services at any time for any reason, including if you violate these Terms. Upon termination, your right to use the Services will immediately cease.
22. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved exclusively in the courts of New York, NY.
23. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
